These Terms of Service ("Terms") govern your access to and use of the websites, apps, and services provided by TestMySpeech AI ("we", "our"). By creating an account or using any feature, you agree to be bound by these Terms.
2. Eligibility & Accounts
- You must be at least 13 years old (or the minimum age required in your jurisdiction).
- You are responsible for the accuracy of your account information and for safeguarding your credentials.
- We may suspend or terminate accounts that violate these Terms.
3. Services & Definitions
We provide AI-assisted speaking practice, including topic generation, speech recording, transcription, automated analysis, and progress tracking. “Session” means a single practice run; “Coins” means our in-app credit used to run Sessions.
4. Coins, Pricing & Payments
- Coins are prepaid credits used to start Sessions. Coin rates per Session are shown in the app.
- Prices are shown in INR unless stated otherwise. Taxes (including GST) may apply.
- Payments are processed by third-party providers. We do not store full card or UPI details.
- Coins are non-transferable and non-redeemable for cash.

5. License & Use Restrictions
We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for personal, non-commercial purposes. You agree not to:
- Reverse engineer, decompile, or attempt to derive source code
- Bypass or interfere with security or usage limits
- Use the Services to build a competing product or dataset
- Automate access (scraping, bots) except via permitted APIs
6. User Content & Permissions
You retain ownership of audio, transcripts, and other content you submit ("User Content"). You grant us a worldwide, non-exclusive, royalty-free license to host, process, and display User Content solely to provide and improve the Services.
Where legally required, we will request additional consent for training or evaluation beyond service provision.
7. AI Output & Limitations
- AI outputs may be inaccurate or incomplete. Use discretion before relying on them.
- You are responsible for how you use any suggestions or feedback.
- We may set usage caps or filters to maintain quality and safety.
8. Acceptable Use
- No unlawful, harmful, hateful, or infringing content
- No harassment, doxxing, or invasion of privacy
- No uploads of content you lack rights to share
- No attempts to extract proprietary data or models
9. Third-Party Services
We rely on cloud providers, AI infrastructure, analytics, and payment processors. Their terms and privacy practices apply in addition to ours. We are not responsible for third-party outages or changes.
10. Beta & Experimental Features
Some features may be labeled as beta or experimental, offered as-is, and may change or be discontinued at any time.
11. Termination
You may stop using the Services at any time. We may suspend or terminate access if you breach these Terms, create risks, or for operational reasons. Upon termination, your license ends and we may delete your data per our Privacy Policy.
12. Cancellations & Refunds
Refunds for coin purchases are governed by our Refund Policy. Where runs fail due to our systems and cannot be retried, coins will not be deducted.

14. Disclaimers
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE ERROR-FREE OR UNINTERRUPTED.
15. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL WE BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL. OUR AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICES SHALL NOT EXCEED THE AMOUNTS YOU PAID TO US FOR THE SERVICES IN THE THREE (3) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
16. Indemnification
You agree to defend, indemnify, and hold us harmless from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Services or violation of these Terms.
17. Governing Law & Disputes
These Terms are governed by the laws of India, without regard to conflict-of-laws principles. Courts in Chennai, Tamil Nadu shall have exclusive jurisdiction. You agree to first attempt informal resolution by contacting support before pursuing formal claims.
18. Changes to Terms
We may update these Terms from time to time. We will post the new date at the top and, when appropriate, notify you via the Service or email. Continued use constitutes acceptance of the updated Terms.
